INTRODUCTION

These general conditions of sale, govern the online sale of the products contained in the website www.94punto70.it and are accepted by the buyer when completing an order.
 
Sg Bags S.r.l. may at any time make updates to these conditions; therefore the conditions that apply to an order are those in force at the time of the order.
 
On the site, the customer finds in writing and in the photos all the most important characteristics relating to products of the brand 94.70 and their selling price. Sg Bags S.r.l. undertakes to ensure maximum accuracy in the information reported online but will not be responsible for any unnecessary errors which will in any case be corrected.
 
Sg Bags S.r.l. moreover, it is not liable for any delays related to the maintenance of the site, to the customer service or other unavoidable circumstances and also attributable to third parties such as for example the interruption of the telephone line or the internet.
 
To make purchases on our e-commerce, the customer must be of legal age and have the legal capacity and the awareness that are not the responsibility of Sg Bags S.r.l. expenses relating to the internet connection for browsing in the 94.70 website and telephone expenses.
 
Orders and any request for information will be managed by our customer service only in Italian and English.
 

PROPERTY RIGHTS

All products of the 94.70 brand are entirely made in Italy; more precisely in the Riviera del Brenta near Venice in the Veneto region.
All figurative trademarks, accessories and packaging branded present in the product are the property and for the exclusive use of Sg Bags S.r.l.
The texts and photos cannot be reproduced even partially without the written consent of Sg Bags S.r.l.
 

ORDERS AND AVAILABILITY

There is no purchase limit on the quantity of 94.70 products, however Sg Bags S.r.l. may refuse the customer’s purchase proposal in cases of unavailability of the desired product, in cases of suspected activity, if there are ongoing disputes, if the order does not comply with these conditions of sale or if some data has not been entered fundamental such as billing and delivery address or contact email.
 
In these cases, Sg Bags S.r.l. will inform the customer and the entire amount will be refunded through the same payment method used by the customer and / or proposed an alternative if the order is not able to be processed.

PAYMENTS

The prices expressed on the site are in Euros and include VAT and excluding shipping costs, except for Italy whose shipping costs are free.
 
Any amount of shipping costs will be displayed upon confirmation by the customer of the shipping method so the customer can decide if continue with the purchase.
 
The customer is responsible for any costs, charges, taxes or duties that the laws of the State indicated for the shipment apply.
 
The customer therefore declares that the lack of knowledge of these costs cannot in any way cause the termination of the contract and such costs cannot be charged to the seller.
 
The accepted payment methods are credit card throught the software Stripe (it is the customer’s commitment to pay with a card of which he is the legitimate owner) and Paypal.
 
In case of non-payment in full, Sg Bags S.r.l. may claim without prior directive any items already delivered to the customer.
 
The customer accepts that the company proceeds with a secure transaction and authorizes their bank to debit the account even in the absence of invoices signed by the cardholder.
 
The buyer’s credit card details are not stored either by payment institutions or by the portal.
 
In the case of using Paypal, the data that the buyer enters on www.paypal.it will be processed directly by Paypal.
 
Before sending the order proposal, it is necessary to check the final sale price as prices may change without notice related to human errors or the increase in the cost of raw materials and / or labor.
 
A transport document and the related invoice will be issued for each purchase based on the information provided by the customer at the time of the order: the documents may not undergo changes after their issue and must be kept for the guarantee.
 

PACKAGING AND SHIPPING

All products are sold inclusive of protective cloth and box and then placed in the shipping box.
 
We entrust all shipments to our trusted courier and upon arrival of the package the customer is required to check the number of packages with the transport document and the integrity of the packaging (it must not be open in any part, not wet or altered).
 
If something is damaged or tampered with, the customer must contest it to the courier by placing the reserve signature on the proof of delivery.
 
If the customer signs without any dispute, he can no longer contest Sg Bags S.r.l. the external appearance of the package or any damage to the goods due to the courier.
 
It is also recommended to check upon receipt of the product that it corresponds to the one ordered; if not, please inform the seller immediately and proceed with the return.
 
Deliveries will be made to the delivery address provided in the order proposal by the customer within 5 working days from the date indicated in the order confirmation or at the latest within 30 days from the order date, otherwise Sg Bags S.r.l. will refund the customer in full.
 
The states where the seller ships can be found by filling out the purchase proposal form.
 
Attention, we do not ship to post office boxes or hotels.
 
We indicate the expected delivery times, but this information is purely indicative and not binding for the seller.

Service availability and transit times may depending on the origin and destination postcode and the type of goods.

Before the end of the purchase proposal, the customer will be able to choose between a standard or priority shipping except for the delivery in Italy for which the shipping is standard.
 

RETURNS 

If the customer wants to cancel the order or modify it, he can contact us but we do not guarantee cancellation or modification if it has already been processed.
 
However, the customer can return it according to the following conditions on the return policy. Within 15 working days from the day of receipt of the goods, the customer can withdraw from the concluded contract even without specifying the reason (right of withdrawal pursuant to Art. 52 of the Consumer Code).
 
However, he cannot request the replacement of one item with another but will eventually have to place a new order.
 
To return the goods, the customer must send a mandatory communication in writing to the email address [email protected] by entering the transport document and invoice number (if it was requested by the customer at the time of purchase) with which he received the goods.
 
The return costs, in this case, are exclusive charge and responsibility of the customer (including any customs fees and any damage, theft or loss that occurred during shipment).

The returned item must be intact in all its parts; a full refund will not be made if it is not complete with all the original packaging (packing box, personalized box, cloth, tag, etc.), or if any component of the bag is missing or if the packaging is not intact.
 
It must also not have been used or damaged. Attention, the customer have also to return a copy of the transport document and the invoice with which the package was received.
 
The customer is fully responsible for the shipment and no refund will be made if the package is tampered with upon arrival, in which case Sg Bags S.r.l. will communicate it to the customer who can file a complaint with the courier to obtain a refund; the request for withdrawal will then be canceled and the item will again be available to the customer.
 
Sg Bags S.r.l. reserves the right to check the return of the customer upon his arrival and if all the requirements have been met, he will send an email confirming acceptance of the return.
 
In the absence of even one requirement, Sg Bags S.r.l. will decrease the amount to be returned to the customer; in this case the customer will be informed that he will be able to choose whether to accept the proposed refund or have the product deliberately returned at his own delivery cost.
 
The withdrawal by the customer must be done within 14 days from the communication of the will to withdraw; while the refund to the customer by Sg Bags S.r.l. will take place within 14 days from the communication of the withdrawal but may be delayed until the moment of receipt and verification of the product or the moment of receipt of the proof of shipment.
 
The method of payment of the refund by Sg Bags S.r.l. will be the same method used by the customer for the purchase.
 

WARRANTY

The sale of our products in reference to the Consumer Code, European Directive 44/99 / EC and Italian Legislative Decree No. 206/2005, provides that the customer has the right to have the article restored if it has a lack of conformity; all products of the 94.70 brand are covered by a two-year warranty from the date of delivery to the customer.
 
Any production defects must be communicated in writing to [email protected] within two months of discovery with an explanatory text and photo and number of the transport document and invoice.
 
The customer will not have to pay anything but it is mandatory to return the product under warranty with the transport document and the invoice (if it was requested by the customer at the time of purchase) with which it was received within 10 days of reporting the defect.
 
Attention, after 6 months from the purchase of the good, the burden of proof could fall on the customer.
 
The guarantee does not cover if the product has been used improperly (for example washing) or the care advice contained in the explanatory tag has not been followed.
 
In this regard, please note that all our products are made with real leather and the veins and shades present are intrinsic characteristics of the leather itself and the wrinkles that are formed are due to its use; small abrasion marks due to the truthfulness leather and consequent to the rubbing between the various components of the bag (for example the handles with the dial) are not considered manufacturing defects.

The general conditions of sale of Sg Bags S.r.l. must be interpreted according to the e-commerce decree governed by Italian law: Legislative Decree 6 September 2005 No. 206 on the Consumer Code and Legislative Decree 9 April 2003 No. 70 for electronic commerce with relative subsequent amendments and additions.
 
The customer also accepts the exclusive jurisdiction of the Italian Court of Venice for consequences deriving from these general conditions.
 

Alternatively, you can rely on the online dispute resolution platform (ODR) made available by the European Commission. The Customer can file a possible complaint following a problem encountered during the online purchase.
